1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ProfileFinder ("Company," "we," "us," or "our") governing your access to and use of the ProfileFinder website and services (collectively, the "Service"). By creating an account, purchasing credits, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

2. Service Description

ProfileFinder provides a suite of AI-assisted identity research tools, currently comprising:

• Face Search: Upload a photo to find visually similar publicly indexed images and associated social media profiles across the web. Query photos are never stored — they are permanently discarded as soon as each search completes;
• Username Search: Enter a username to search for matching accounts across 50+ public platforms including social media, forums, gaming networks, and creative platforms. We do not access private accounts or content behind authentication.

The Service is designed for legal and ethical purposes including public-profile research, reconnecting with lost contacts, researching public figures, and online identity verification. Use of the Service must comply with all applicable local laws and regulations regarding privacy and data protection.

ProfileFinder is an informational research tool only. All results are sourced from third-party public web content. We do not create, maintain, host, or guarantee the accuracy of any profile data returned by our Service. We are a conduit to publicly available information — not a data broker, background check service, or law enforcement resource. We do not store uploaded photos or any biometric data at any point.

3. Eligibility & Account

To use the Service, you must:

• Have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
• Be accessing the Service from a jurisdiction where this type of online identity search is lawful;
• Not be prohibited from receiving services from us under any applicable law; and
• Provide accurate, current, and complete registration information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at profilefindersupport@gmail.com if you suspect unauthorized access to your account.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You represent, warrant, and agree that you will NOT use the Service to:

• Stalk, harass, intimidate, threaten, or harm any person;
• Conduct surveillance on any individual without a legitimate legal basis;
• Track a person's location, movements, or activities;
• Compile dossiers or aggregated profiles on individuals for commercial sale;
• Conduct formal employment screening, tenant vetting, credit decisions, or any other purpose regulated by the FCRA (see Section 5);
• Search for a minor (any person under 18 years of age);
• Impersonate any person or entity or misrepresent your affiliation;
• Violate any applicable local, state, national, or international law or regulation;
• Infringe upon the privacy rights of any individual;
• Resell, sublicense, or redistribute access to the Service without express written consent;
• Use automated scripts, bots, or scrapers to access the Service; or
• Circumvent any access controls, rate limits, or security features of the Service.

5. FCRA Disclaimer — IMPORTANT

Specifically, you may NOT use results from ProfileFinder for:

• Evaluating a candidate for employment, promotion, or reassignment;
• Evaluating a person's eligibility for credit or insurance;
• Tenant screening or rental decisions;
• Licensing determinations; or
• Any other purpose that would constitute use of a consumer report under the FCRA.

By using the Service, you certify that you are not using it for any of the foregoing purposes. We disclaim all liability for any harm resulting from your violation of this provision. Violations may be reported to relevant regulatory authorities.

6. Credits & Payments

Access to the Service's search features requires purchasing credits. Credits are a non-refundable, non-transferable digital token redeemable for use of the Service. One (1) credit is consumed per successful face search or username search. Credits are not consumed for failed searches caused by a verifiable fault on our end, in which case the credit is automatically returned to your balance.

• Credits never expire so long as your account remains active;
• All sales are final and non-refundable;
• Credits are forfeited upon account deletion or termination for breach of these Terms;
• We reserve the right to adjust pricing at any time; existing purchased credits are not affected by pricing changes.

All payment processing is handled by our third-party payment processor. By completing a purchase, you agree to their terms of service and privacy policy. ProfileFinder does not store your payment card details.

7. No Warranty of Accuracy

Search results generated by ProfileFinder are produced by third-party AI systems and may contain errors, omissions, or misidentifications. Facial recognition technology is imperfect and can produce false positives (incorrect matches) or false negatives (missed matches). Factors including image quality, lighting, aging, cosmetic changes, and deliberate obfuscation can degrade accuracy.

ProfileFinder results should be treated as unverified investigative leads only. You must independently verify any information before taking action based on search results. ProfileFinder disclaims all liability for harm caused by acting on inaccurate, incomplete, or misleading search results.

8. Intellectual Property

All content, software, trademarks, logos, and other intellectual property associated with ProfileFinder are owned by or licensed to us and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of images you upload. By uploading an image, you grant ProfileFinder a limited, transient, non-exclusive license to process that image solely for the purpose of executing your requested search. This license terminates immediately upon completion of the search.

9. Third-Party Services

The Service integrates with carefully vetted third-party providers for functions including AI-powered image analysis, payment processing, and secure cloud infrastructure. Your use of the Service may also be subject to the terms and privacy policies of those providers where applicable. ProfileFinder is not responsible for the practices, policies, or content of third-party services.

Search results may contain links to third-party websites. We do not endorse or control third-party content and bear no responsibility for it.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROFILEFINDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) results will be accurate, complete, or current; (c) any defects will be corrected; or (d) the Service is free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROFILEFINDER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your access to or use of, or inability to access or use, the Service;
• Any conduct or content of a third party on the Service;
• Inaccurate, incomplete, or misleading search results;
• Your violation of these Terms or applicable law; or
• Unauthorized access to or alteration of your data.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for consequential damages, so the above limitations may not apply to you in full.

12. Indemnification

You agree to indemnify, defend, and hold harmless ProfileFinder and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service in violation of applicable law; (c) your infringement of any third-party right including privacy rights; or (d) your use of search results to make decisions affecting any third party.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason including a breach of these Terms. Upon termination for any reason, you forfeit all unused credits.

You may terminate your account at any time via your account settings. Sections 4, 5, 7, 10, 11, 12, and 14 survive termination.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising under or related to these Terms shall be resolved by binding individual arbitration under the rules of the American Arbitration Association ("AAA"). You waive your right to a jury trial and to participate in a class action.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email to the address on your account or via a prominent notice on the Service at least 14 days before taking effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
